Case Study - Overhead Electricity Cable Compensation

In summer of 2009 Kirkby & Diamond were instructed by the owner of a residential property in Borehamwood, Herts.

The client had acquired the property earlier that year.  The property was a 1960’s three bedroom semi-detached house with a sizeable garden.  Across the bottom corner of part of the garden there was a line of electricity cables.

Kirkby & Diamond’s surveyors approached the electricity company and submitted a claim for compensation.  The claim was based on a percentage of the value of the property – and therefore the higher the value of the property, then potentially the higher the claim.  Terms were subsequently agreed and solicitors instructed.

We were able to agree the claim at nearly £10,000.  All costs were paid by the electricity company.

The process can be relatively quick but detailed legal enquiries may be required to ensure there are no pre-existing agreements for the electricity equipment.  This can delay the process.  It is conceivable, most discussions are concluded and compensation paid in 4-6 months.
