When this happens the parties may attempt to negotiate an equitable apportionment of the proceeds based on a crude or poorly researched assessment of their respective negotiating positions. Inappropriate planning assumptions can be made and material considerations overlooked. Resulting in incorrect values and lost opportunity.

In most cases, however, where professional valuers are appointed, a 'correct' valuation based solution can be found.  It is vitally important, therefore, that the valuation issues are fully investigated and that the availability of alternative solutions are tested before attempting to agree terms.
